"What is personal injury law?"

The plaintiff in a personal injury lawsuit seeks financial compensation for the harm he or she has experienced, including physical, emotional, and financial loss. The compensation may cover past, present, and future medical expenses, loss of income, pain, and suffering, and other damages. In the case of wrongful death, the victim's family may bring legal action to seek compensation for the death of a loved one. If the victim's injuries or the wrongful death are caused by intentional or malicious acts, then punitive damages may be awarded in addition to the compensation for injuries. Punitive damages are designed to punish the responsible party and deter others from acting in a similar manner.

The plaintiff must prove two things to succeed in a personal injury lawsuit.

First, the person or party being sued is legally responsible for causing the injury or loss.

Second, the damages sought accurately reflect the scope of the injury or loss experienced by the victim or the victim's family. As these facts become established, both sides in a personal injury or wrongful death lawsuit might agree to a financial settlement instead of going to trial.
